SCOTUS decision on 2nd Amendment
5-4 in FAVOR of the right of an individual to “keep and bear arms” for self defense. 5-4…How come it wasn’t 9-0?
Justice Scalia (Roberts, Kennedy, Thomas and Alito joining): Undoubtedly some think that the Second Amendment is outmoded in a society where our standing army is the pride of our Nation, where well-trained police forces provide personal security, and where gun violence is a serious problem. That is perhaps debatable, but what is not debatable is that it is not the role of this Court to
pronounce the Second Amendment extinct.
Justice Breyer (Stevens, Souter and Ginsburg joining): In my view, there simply is no untouchable constitutional right guaranteed by the Second Amendment to keep loaded handguns in the house in crime-ridden urban areas. (Excuse me…but Breyer doesn’t believe you have a RIGHT to protect yourself? What an idiot.)
Justice Stevens (Souter, Ginsburg and Breyer joining): Specifically, there is no indication that the Framers of the Amendment intended to enshrine the common-law right of self-defense in the Constitution. (The Framers of the Constitution didn’t believe in the age old right of self defense? Another idiot!!)
